What is wrongful death?

The legal definition states that wrongful death occurs when a negligent or intentional action results in the death of another person. Even if someone is injured in an accident – for example, a man riding a bicycle is hit by a car and hospitalized – and later dies as a result of those injuries, a wrongful death claim could arise.

Other incidents in which wrongful death claims include car accidents, truck accidents and medical malpractice. The Orange County personal injury lawyers of Pacific Attorney Group fully understand California’s insurance and liability laws, as well as the different sources of recovery available to your family.

A wrongful death lawsuit is filed on behalf of the victim’s survivors, who may be entitled to monetary damages as a result of the death. Exactly who may seek damages varies from state to state. In California, only the heirs and dependents of the deceased can seek damages. That means a spouse or domestic partner, children, offspring of deceased children or, if there are no surviving children, the people who would be entitled to the victim’s property if he or she died “intestate” – without a legal will.

Types of wrongful death damages in Orange County

At Pacific Attorney Group, our Orange County personal injury lawyers know that this is an incredibly difficult time for everyone involved. There is no way to truly compensate your family for the loss of your loved one, but we will make sure to fight for your right to damages.

In California, our lawyers are authorized to seek compensation for the loss of love, companionship, moral support, financial support and any household services that would have been received had there not been the wrongful death of the victim. Additional wrongful death damages to which you may be entitled:

  • Loss of gifts and benefits
  • Funeral and burial expenses
  • Loss of enjoyment of sexual relations
  • Loss of training and guidance
  • Loss of comfort, care, assistance, protection, affection and society

Sometimes, punitive (punishment) damages are awarded, depending on what cause of action the victim would have had if he or she had survived. For example, if someone intentionally shot your loved one, you may be entitled to punitive damages because the charge would be intentional homicide. Punitive damages are intended to punish the person or company at fault for intentional or outrageous conduct.

Pacific Attorney Group and wrongful death cases

If you feel you have a potential wrongful death case, don’t wait too long to contact the personal injury lawyers of Pacific Attorney Group. The current statute of limitations for filing a wrongful death lawsuit in the state of California is two years from the date of the incident or accident. If your claim is against the post office, state highway department or other governmental entity, you only have six months to file your claim.

Regardless of a claim’s merit, if the claim is not filed in time, it will be deemed legally invalid, regardless of what caused the delay. This is because the passage of time can affect one’s memory of the event, or cause evidence to be lost, along with witnesses. Limitations ensure the passage of time does not cause the court to be biased against either side.
